Please review the following terms governing your use of the Fair TPRM platform and test drive services.

1. Use at Your Own Risk

The Fair TPRM platform, including all test drive environments, is provided "as-is" and "as-available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Your use of the Fair TPRM test drive is entirely at your own risk. Fair TPRM, its owners, operators, employees, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, loss of profits, business interruption, or any other commercial or personal harm.

2. No Responsibility for Data Loss or Harm

Fair TPRM is not responsible for any data loss, data corruption, unauthorized access, security breaches, or other harm that may occur during your use of the test drive or paid environments. This includes, but is not limited to:

  • Data entered, uploaded, imported, or stored within your Fair TPRM instance
  • Configuration changes, integrations, or customizations made during the test drive or subscription period
  • Any data loss resulting from scheduled or unscheduled system maintenance, platform outages, or infrastructure failures
  • Data loss upon expiration or termination of a test drive or subscription
  • Security incidents arising from user-configured settings, weak credentials, or third-party integrations
  • Any loss resulting from the actions or inactions of third-party service providers integrated with the platform (e.g., Shodan, UpGuard)

3. Customer Responsibility to Backup Data

It is your sole responsibility to maintain adequate and regular backups of any data entered into your Fair TPRM instance, whether you are a test drive or paid customer. You are strongly encouraged to regularly export and back up your data throughout the duration of your use of the platform.

Fair TPRM will not recover, restore, or be held accountable for any data that is lost during or after any test drive or subscription period. You acknowledge that data preservation is your responsibility and that you have been advised to maintain local backups.

4. Test Drive vs. Paid Customer Backup Policies

Backup policies differ between test drive and paid customer tiers:

  • Test Drive Customers: No automated server-side backups are performed for test drive environments. Test drive customers are solely responsible for backing up their own data during the test drive period. Upon test drive expiration, all data and environments are permanently and irrecoverably deleted.
  • Paid Customers: Server-side backups are performed on a weekly basis as part of the paid service agreement. These backups are managed by Fair TPRM to support data resilience and recovery capability. However, Fair TPRM makes no guarantees regarding the completeness, integrity, or recoverability of these backups.
  • All Customers (Test Drive & Paid): Both test drive and paid customers have the ability to create on-demand backups directly within the platform and download them locally to their own machines for archiving and safekeeping purposes. We strongly recommend all users take advantage of this feature regularly, regardless of their subscription tier.

5. Test Drive Period & Expiration

The Fair TPRM test drive provides a fully functional, dedicated instance for a period of 90 days from the date of provisioning. No credit card is required to begin a test drive.

Upon expiration of the test drive period, your test drive environment and all associated data will be permanently and irrecoverably deleted without further notice. It is your responsibility to export any data you wish to retain before the test drive expires. Fair TPRM assumes no obligation to preserve, migrate, or make available any data beyond the test drive period.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Fair TPRM and its owners, operators, employees, agents, and affiliates shall not be liable for any damages of any kind arising from or related to your use of the platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

In no event shall the total liability of Fair TPRM exceed the total fees paid by you (if any) for the services during the twelve (12) months preceding the event giving rise to the claim. For test drive customers, this liability is limited to zero ($0).

7. Indemnification

You agree to indemnify, defend, and hold harmless Fair TPRM and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your violation of any rights of a third party.

8. Modifications to Terms

Fair TPRM reserves the right to modify these Terms & Conditions at any time. Changes will be effective upon posting to this page. Your continued use of the platform after any such changes constitutes your acceptance of the new terms. We encourage you to review this page periodically.

9. Acceptance of Terms

By signing up for a Fair TPRM test drive, verifying your email address, or continuing to use the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. A summary of these terms is provided in your verification email and welcome email for your records.
